KUALA LUMPUR - AN ETHNIC Chinese man was buried as a Muslim following a court ruling, triggering angry protests on Friday from his family who said he was a Buddhist and had never converted to Islam.
It is the latest in an increasing number of interfaith conflicts that have raised tensions in multi-ethnic Malaysia.

About 60 per cent of Malaysians are Muslim Malays, and most disputes that landed in court have ended against non-Muslims who feel their religious rights are under threat.

An Islamic Shariah High Court in the central Negeri Sembilan state ruled on Thursday that Gan Eng Gor, 74, also identified as Amir Gan Abdullah, was a Muslim and should be buried under Islamic rites. The burial took place late Thursday in Negeri Sembilan.

The man's body was seized by police on a complaint by his eldest son, Abdul Rahman Gan, a Muslim convert.

He claimed his father had changed his religion from Buddhism to Islam last July.

The rest of the family disputed this, and the case came to the Shariah High Court.

The court's judge, Mohamad Nadzri Abdul Rahman, told reporters he ruled in favour of the eldest son because Mr Amir's wife and seven other children, who had disputed the conversion, were not in court on Thursday and he couldn't hear their arguments.

Gan Hock Sin, another son of the dead man, said the family didn't go to the Shariah court because they felt it was unfair to hear the case there.

'It's not fair for us. I don't know how they say he converted. My father couldn't even talk (before his death),' Mr Gan told the reporters.

'Unfortunately we feel the way they do (these conversions) is not fair for non-Muslim people. The government should be more transparent,' he said.

He said the police seized the body when the family was carrying out Buddhist rites in a Chinese funeral parlor.

The family had asked the state's civil High Court to hear the case, but a judge ruled he had no jurisdiction in the matter as the Shariah court had already made a decision, said a court official, who declined to be named citing protocol.

Malaysia has a dual court system for civil matters with secular courts for non-Muslims and Shariah courts for Muslims.

In interfaith disputes, involving Muslims, the Shariah court usually gets the last word, making a favorable decision for professed non-Muslims less likely.

The latest case follows another one earlier this month where Islamic authorities claimed a woman?s body, arguing she converted to Islam.

Her husband, who maintained she had been Christian until her death, won the case after authorities retracted their claims because they found that the conversion had not been done according to Islamic law.

A quarter of the country's 27 million people is ethnic Chinese, who are mostly Taoist, Buddhists and Christians, and 8 per cent are ethnic Indians, many of whom are Hindus. -- AP

This is why I left Malaysia to study and work in Singapore. Maybe I will stay in Singapore, if not in Australia.

There is no laws in Malaysia. The only laws I know is made for Malays only.

The jokes on Malaysia and the shariah court.
People cant even rest in peace.
Sometimes its bcoz of the registration got mixed up and non-muslim were stated as muslim, then here comes the shariah court. Its as if they were vultures waiting for ppl 2 die.

It is because in their country have no religion freedom not like us in Singapore we can convert even if Singaporean once a muslim they can convert to another religion of their choice.

If for example in malaysia they register wrongly for him as a muslim he will be lifetime a muslim he cant convert or revert back to the religion of choice!

Their excuse?

Malaysia is an Islamic country.

You wont' be seeing any dispute over other religions unless it involves Islam.Makes other ppl have bad impressions on the muslims.

KUALA LUMPUR - THE family of an ethnic Chinese man buried as a Muslim despite protests that he was Buddhist urged Malaysia's government on Monday to review the case.

Gan Hock Ming said his family has appealed to the High Court in southern Seremban state to challenge an Islamic Shariah court ruling that his late father, Gan Eng Gor, had converted to Islam before his death.

'We want a declaration that he is not a Muslim. Our main intention is to seek justice, not just for our family but for the rest of the non-Muslim community,' Hock Ming told The Associated Press.

The case is expected to be heard on Tuesday, he said.

It is the latest in an increasing number of interfaith conflicts that have raised tensions in multiracial Malaysia.

On Monday, opposition lawmaker Lim Kit Siang urged the government to end 'body-snatchings' by Islamic authorities, warning they were aggravating racial polarisation and hurting Malaysia's multiracial harmony.

Last week, an Islamic Shariah court ruled that Eng Gor, 74, also identified as Amir Gan Abdullah, was a Muslim and should be buried under Islamic rites.

The man's body was seized by Islamic authorities shortly after his death on Jan 20 after a complaint by his eldest son, Abdul Rahman Gan, a Muslim convert. He claimed his father had changed his religion from Buddhism to Islam last July. His family disputed this.

Hock Ming said Islamic authorities claimed his bedridden father made an oral declaration in Arabic to accept Islam, but the family has medical confirmation that his father was unable to speak after a stroke in 2006.

He said the alleged conversion papers were also flawed because they weren't signed and certified.

'We hope the prime minister and the higher ups in the Islamic authorities review this case and ensure that the truth is unraveled,' Hock Ming said, calling for all conversions to Islam to be 'fair and transparent.'

Since the family say that their father unable to speak after a stroke in 2006 then any prove that he himself wants a convert?

Ppl have their own free will over religion they passed away liao still argue that they are a convert Islam what the point. I wonder the authorities claim that the ppl died are convert Islam is there any benefit for them?
