Jail and rotan for fisherman who raped teacher

IPOH, MALAYSIA - A fisherman was sentenced to seven years' jail and ordered to be whipped three times after he pleaded guilty to raping a 19-year-old teacher in Sitiawan five years ago.
Mohamad Khairi Bahauddin, 26, who changed his plea midway through his trial, was further sentenced to four years' jail for robbing the girl of RM30 and her Nokia mobile phone worth RM200 at the time of the rape behind Chong Cheng School in Taman Rasa Sayang on Dec 8, 2003, at about 6.30am.
Sessions Court judge Hashim Hamzah ordered the sentences to run concurrently from the date of his arrest on Dec 11, 2003.
According to the facts of the case, the teacher was cycling alone along an alley towards her friend's house in Taman Rasa Sayang when Mohamad Khairi rammed his motorcycle into the back of her bicycle.
She was thrown off her bicycle and fell into a drain.
When she tried to call for help, Mohamad Khairi snatched her mobile phone along with her bag containing RM30.
He then dragged her into some bushes and took off her clothes. During he struggle that ensued, she scratched Mohamad Khairi's neck.
Mohamad Khairi forced her into an empty house, threw her onto the floor and raped her.
She tried to hit him with a wooden plank but failed to stop him.
Earlier, defence counsel Rajit Singh Gill urged the court to consider Mohamad Khairi's plea of guilt.
'If the accused pleads guilty, it warrants him a discount,' he said, adding that Mohamad Khairi, who had been in remand since his arrest, had spent his youth in prison.
However, Deputy Public Prosecutor Ahmad Ishrakh Saad told the court to take into account public interest.
'Sexual crimes have become more widespread and the law is an effective method to curb that,' he said, adding that the incident had caused tremendous trauma and hurt to the victim and her family.
Mohamad Khairi, he added, had not pleaded guilty at the first opportunity given to him but had done so only four years later during mid-trial.
Asking the court to impose a deterrent sentence, Ahmad Ishrakh said it was necessary to send a clear message and warning to all would-be offenders.
