Did his phone ring?


YOU had sexually assaulted and then murdered her, said the prosecution at the start of the criminal trial yesterday.

But Mohammed Ali Johari had told the police otherwise. In his statements to them, he insisted her death was an accident.

He is charged with murdering his stepdaughter, Nur Asyura Mohamed Fauzi, 2, better known as Nonoi.


Mohammed Ali admitted to the police that he had repeatedly submerged the toddler's head in a pail of water.

But distracted by a phone call, he claimed he had forgotten about the girl and she drowned.

The prosecution thought otherwise. The story about the drowning and the phone call was a lie the accused told his family and the police, it said.

This is so he could hide the brutal attack on Nonoi, which may have included a sexual assault, the prosecution added.

Deputy Public Prosecutor (DPP) Christopher Ong told the court yesterday that there was evidence that the girl had suffered injuries to her private parts.

And there was evidence of sexual activity.

He added that evidence to be presented by Associate Professor Gilbert Lau from the Health Sciences Authority's (HSA) centre for forensic medicine will show that these injuries were likely caused just before her death.

That's why the prosecution, which also included DPPs Tan Wee Soon and Vinesh Winodan, believe that Nonoi died because the accused had wanted to cover up the vaginal injuries he had caused.

On 1 Mar last year, Nonoi was reported missing from Mohammed Ali's father's ground-floor Circuit Road flat.

Her partially-decomposed body was found wedged in a small gap under the Aljunied flyover on 4 Mar.

Two days later, the accused, a despatch rider, was charged with murder. The charge carries the death penalty.

On the first day of his trial yesterday, the 30-year-old appeared in a white T-shirt and a brown pair of pants. He appeared to have put on weight.

Accused of murdering Nonoi in their one-room flat in Pipit Road, he appeared before Justice Kan Ting Chiu, who was presiding over the case.

LOOKED SOLEMN

Represented by Mr R S Bajwa and Mr Sarindar Singh, he looked solemn in the dock.

Reading his opening statement, Mr Ong told the court that on 1 Mar, Mohammed Ali and Nonoi's mother, Madam Matsura Kamsir, had sent the girl and her younger brother to Mohammed Ali's parents' flat at Circuit Road. It was their daily routine.

That night at 7pm, Mohammed Ali's father, Mr Johari Mohammed Yus, discovered the girl missing.

He informed the other family members and they looked for her but failed to find her. They made a police report. On 2 and 3 Mar, a massive search was conducted but to no avail.

Mr Ong said that on the morning of 4 Mar, Mohammed Ali had admitted to the family that he had drowned Nonoi.

He surrendered that day at 11.45am at Bedok Police Station. After being arrested, he led the police to a spot under the Aljunied flyover, where the body was found.

Mr Ong said in Mohammed Ali's statements he had admitted causing Nonoi's death by repeatedly immersing her head-first in water and she drowned.

Mr Ong said the accused claimed he had been distracted by a call on his handphone.

But by analysing his handphone records, they will prove he did not receive or make any calls at the time of the girl's drowning, he added.

Yesterday, six witnesses took the stand, including police photographers and sketch plan artists from the Criminal Investigation Department's forensic management branch.

Witness Dr Danny Lo, a consultant forensic scientist from HSA's centre for forensic science, said that Nonoi's bile and liver, which had been sent to him for analysis, showed no foreign compounds in her body.

The trial continues today and is expected to last till 17 Apr.

A total of 36 witnesses are expected to testify, including Nonoi's mother, Mohammed Ali's parents and his three siblings.

i think the best punishment for him would be a life sentence with daily head-submerging sessions
