Total SGC$: 1,869.91 | Employment Act Last year December, my company CFO spread the news that CEO is going to give money to those who still have many annual leaves. Everyone believed that and don't want to take leave so that can get more money back home...
Yesterday, CFO suddenly announced that company will not pay money for unused annual leave and all the annual leave cannot bring forward to this year. Everybody felt like deceived by company but cannot do anything...
I am damn not happy  and I wrote to MOM and below is the reply I got today from a Labour Relations Officer...
The Employment Act, which the Ministry of Manpower administers, spells out the basic terms and conditions of employment in Singapore. It is applicable to employees across the board. The Act does not differentiate between employees of different sectors and industries. However, the Act does not cover any person employed in a managerial, executive or confidential position. In addition, Part IV of the Employment Act which spells out the provisions on annual leave is applicable only to manual workers (regardless of salary) and other employees earning $1,600 or less per month. If you are not covered by the Employment Act or earn more than $1600 per month, your terms and conditions of employment pertaining to your annual leave entitlement are purely governed by the employment contract or negotiation/mutual agreement between you and the employer.
What did you feel after reading this? It seems to me that Employment Act of Singapore only protect those employees in low level from being further exploit by employers...
So don't be a stupid like me, work like hell day and night... use all your annual leaves because your company can cheat you anytime if they liked.

But with Diploma and Degrees so common nowadays, everywhere is executives so does the employment act still stand in the long run? who knows? Leo~

2 things..Not happy..leave..or Accept it and just work around it...anyway there is no more iron ricebowls around..Loyalty to a single employment is also.. I believe should be the thing of the past..right now..I think is time to go just to where the $$ is..if you want to work..go to an employment that willing to pay what you think your time is worth..and make sure you happy with it..although if just briefly..and also..if posible create your own alternative/additional income.. From what i know most companies pay their staff for uncleared leaves. |

yes, the employment act only covers for the lower level staff. i kena before... same, i wrote to MOM and they gave the same reply.... although the matter was different from the TS'
anyway, if you're not covered by the employment act, join a union, like NTUC, so at least they will be able to help you if the need arises (for e.g. in the case of retrenchment). Total SGC$: 41.66 | Re: Employment Act There is no standard on this as stated clearly in the Employment Act from MOM. (As clearly understandable, it covers mainly for lower level employees)
The policy on annual leave is purely dependent on your company's policy, which I also find insecure at certain times, especially when HR decides to change its policy.
In my company for example, HR allows flexibility in bringing forward the unused portion of annual leave to the maximum of first quarter of the following year. But just recently, with new CEO and SVP HR, we are only allowed to carry forward a maximum of 10 annual leave per year.
Definitely, good company will allow some transition period before new policy is implemented. At least, employees would not feel cheated.
I think, most employment contract will not state this in black and white. Always take the initiative to check the employees handbook, or contact HR and keep yourself updated.
